Overview

Philip R. Voluck, who is rated AV® Preeminent™ by Martindale-Hubbell, has concentrated his more than 40 years of practice in the area of employment practices liability defense, with a particular emphasis on handling claims of employment discrimination, public access litigation, retaliation and wrongful discharge. As co-chair of KDV’s Labor and Employment Law Practice Group, his practice includes representing insurance carriers and their insureds as well as private companies before many federal and state courts and most federal and state agencies, including the United States Equal Employment Opportunity Commission, United States Department of Labor, and the Occupational Safety and Health Agency.

Mr. Voluck has also litigated employment claims in courts and agencies in New Jersey, New York, Delaware, Indiana, Florida, Ohio, Kentucky, and California.

Mr. Voluck advises clients on many day-to-day workplace issues such as employee discipline and discharge, layoffs and recalls, and how to prevent claims from arising. He is well-versed in the multitude of new employment laws arising out of the COVID-19 pandemic, and how they apply to the business community,

In addition to his employment law defense litigation practice , Mr. Voluck has extensive national experience defending businesses sued under Title III of the Americans With Disabilities Act (ADA), because their websites are alleged to be inaccessible to the disabled.

Mr. Voluck is frequently tapped by national media for his employment law and ADA web accessibility insights, and presents speeches, seminars and training sessions before many business and trade associations. Additionally, he is a published author of numerous articles on diverse employment law, professional liability, and web accessibility topics. He was chair of the Professional Liability Underwriting Society’s (PLUS) Mid-Atlantic Chapter from 2007 to 2009. PLUS is an international organization that is recognized in the industry as the primary source of professional liability educational programs and seminars. Mr. Voluck also co-chaired the PLUS Professional Risk Symposium for several years, and sat on the PLUS Content Committee, which selects topics and speakers for the PLUS International Conference.
