Overview

Nicholas J. Falcone focuses his practice on all aspects of employment litigation including, wage and hour violations, wrongful termination, sexual harassment, age and race discrimination, hostile work environment, and retaliation.  He advises and represents employers in a broad range of employment matters including Title VII, The Americans with Disabilities Act, The Family and Medical Leave Act, The New Jersey Family Leave Act, The New Jersey Law Against Discrimination, New Jersey’s Conscientious Employee Protection Act. He also provides human resources counseling on employee leave, disability, and wage and hour issues, as well as on performance management and termination. Mr. Falcone represents clients in state court, federal court, and administrative hearings.

In addition, Mr. Falcone has significant experience in commercial litigation, which includes defending a variety of business clients in non-compete agreements, restrictive covenants, trade secrets unfair competition, and actions in lieu of prerogative writs for land development litigation.  

He is a contributing author to Goldstein and Goodman, New Jersey Practice, Vol. 18 Employment Law (Thomas/West, Second Ed.)

Prior to becoming an attorney, Mr. Falcone worked in the Broadway theater industry, and served on the Board of Directors of the Garden State Film Festival, 2009 – 2019, including as Chairman of the Board and Chairman of the Programming Committee for the last six of those years.
