Emmalee McCarthy focuses her practice on real estate litigation, including commercial and residential matters. She handles landlord-tenant litigation matters and represents clients in matters involving commercial and residential breach of contract, quiet title actions, unlawful detainer lawsuits, tenant buy-out negotiations, and property management resolutions.
She represents Homeowners’ Associations, members of Homeowners’ Associations, real estate brokers/agents, and property owners. She also represents tenants in matters relating to land use, quiet title actions, co-ownership issues, purchase/sale disputes, and nondisclosure claims in addition to boundary, title, development, and construction matters.
Ms. McCarthy most recently served KDV as a law clerk, and prior to that, Ms. McCarthy filled several high-profile law clerk positions. At the Writs and Appeals Division of the Orange County Public Defender’s Office, she worked on motions for dismissal regarding Penal Code Section 995, performed research on judicial bias and recusal, assisted in drafting a motion for recusing a Superior Court judge, and drafted opening briefs for misdemeanor convictions.
As a law firm clerk at a civil litigation firm, she assisted in the areas of tort liability, contract claims, bench trials, arbitration clauses, construction defect claims, wrongful termination, and joint employer liability. As a summer law clerk at the California Department of Justice’s Licensing Section of the Civil Division, she assisted in hearings, and at the Children’s Law Center of California, Ms. McCarthy helped with trial preparation and learned proper methods for interviewing children.
During law school, Ms. McCarthy was the Editor in Chief of the Pacific Basin Law Journal and an executive board member of the Criminal Justice Society.
