Keith Gutstein, co-managing partner of Kaufman Dolowich & Voluck LLP’s Long Island office and co-leader of the firm’s employment practice, similarly said that the state’s lowering of the severe and pervasive bar is a “very significant” development. “So we have seen claims brought under state law that would not have been sustainable under state law in the past,” Gutstein said.
