Law360, New York (May 07, 2012, 6:43 PM ET) — Proposed new rules by California labor officials governing pregnancy and disability discrimination that include lactation as a protected medical condition open the door to employee abuse and a potential new wave of litigation, attorneys say.

The regulations, proposed in March by California’s Fair Employment and Housing Commission, aim to provide reasonable accommodation for lactating women and incorporate changes to the state’s Fair Employment and Housing Act that include a new law requiring employers to maintain health plan coverage for employees on pregnancy disability leave.
