Law360, New York (July 28, 2015, 6:41 PM ET) — Erie Insurance Exchange can’t substitute for a business owner in a suit holding him responsible for a worker’s accidental death, the Third Circuit held Tuesday, finding that the insurer’s case would present separate, unlitigated issues.

A three-judge appeals panel also said that Stephen P. Koons’ case seeking coverage from Greenwich Insurance Co. for the wrongful death claims brought by the estate of Jeremy Andre, who was crushed by a garbage truck, was mooted by Erie’s agreement to settle those claims.
