Before a 5-2 majority of the high court issued its opinion Wednesday in corrections officer Ilda Aguas’ state Law Against Discrimination suit, it wasn’t clear how a New Jersey employer could defend itself if a supervisor allegedly sexually harassed a subordinate and created a hostile work environment even though the employer took reasonable care and acted promptly to investigate and resolve any problems, according to Anna Maria Tejada of Kaufman Dolowich & Voluck LLP.
