Construction Law and Surety

In our Construction Law/Fidelity & Surety Law practice, KDVG offers a comprehensive range of services to developers, general contractors, construction managers, subcontractors, architects, engineers, design professionals, material suppliers and surety companies.

KDVG handles private and public construction project disputes, breach of contract prosecution and defense, performance and payment bonds, non-payment, defective work, mechanics’ liens, delay claims, drafting and negotiating favorable terms and conditions in our clients’ contracts.

During construction, we advise clients how to deal with disputes as they arise and how to comply with contractual and statutory requirements to maintain claims and/or defenses in the event of litigation.

When our clients cannot change the material terms of a contract as in a prime contract for a public improvement project, our attorneys review the contract and advise them regarding the conditions that require compliance during the course of construction. By complying with conditions, they can maintain claims for extra work, time extensions and delay damages -- if the contract does not have a “no damage for delay” clause.

Our attorneys handle litigation with emphasis on cost effectiveness and the client’s operational needs, regardless of the nature of the claim. We place our clients first, position them for potential litigation and develop strategies for early claim resolution either through settlement or through motion.

We know that the earlier we are involved in the construction process the less likely litigation arises before, during or after the project. By negotiating and drafting construction contracts, we minimize subsequent disputes based on conflicting or strained interpretations. Similarly, by giving advice during construction, we minimize post project litigation and maximize the prospect of success if litigation is unavoidable. When unavoidable, our attorneys litigate with their usual commitment and determination to bring about successful outcomes.
