Daniel H. Brody concentrates in insurance coverage representing insurance carriers from the inception of claims through coverage litigation as well as directors & officers liability; other claims-made policies including errors & omissions, employment practices liability and fiduciary policies; and primary, excess and difference-in-conditions policies.
Mr. Brody drafts coverage position letters and opinions for insurance carriers and conducts research regarding the impact of various state laws on unique coverage issues. He negotiates coverage-related settlements, including defense cost allocation agreements, and monitors sophisticated securities class actions and other complex underlying claims. If a coverage dispute cannot be resolved amicably, he assists in handling all aspects of coverage litigation.
While he concentrates in insurance coverage, Mr. Brody also engages in other commercial litigation and represents defendants in professional liability and employment discrimination lawsuits.
Mr. Brody co-authored an article with Ivan J. Dolowich entitled, "Policyholder Financial Impairments Raise Director & Officer Coverage Questions," which was published in the November 3, 2008 issue of National Underwriter. The authors discuss the potential effects of the subprime mortgage crisis on D&O policies.
Mr. Brody received his Juris Doctorate from Hofstra University School of Law, graduating cum laude. While there, he served as Articles Editor of the Hofstra Law Review. He was also a member of the Moot Court Association and participated in the Intensive Trial Advocacy Program and the Public Service Certificate Program. He earned a Bachelor of Arts degree from Binghamton University.
Mr. Brody is admitted to practice in New York and before the United States District Courts for the Southern and Eastern Districts of New York.
